Cases Instituted Under Consumer Protection Act, 1986 Shall Be Proceed With Under The Same Act

 In a judgment dated 16th March, 2021 passed in Civil Appeal nos. 3766-3767 of 2020 "Neena Aneja & Anr. vs Jai Prakash Associates Ltd." the Hon'ble Bench of Justice Dr. D. Y. Chandrachud and Justice Mr. M. R. Shah of the Hon'ble Supreme Court of India has held that proceedings instituted under the provisions of Consumer Protection Act, 1986 before 20th July, 2020 (the date on which certain provisions of the Consumer Protection Act, 2019 came into effect) shall be proceeded with as per the said Consumer Protection Act, 1986.

It was further held through the said judgment that the said matters instituted under the provisions of Consumer Protection Act, 1986 before 20th July, 2020 shall be proceeded with before the respective fora as per the pecuniary jurisdiction prescribed under the Consumer Protection Act, 1986 and not be transferred in terms of the pecuniary jurisdiction set for the fora established under the Act of 2019.
